How Can an Attorney Defend a Client Against DWI Charges?

There are a variety of defense strategies attorneys use to help clients overcome charges of driving while intoxicated. They include:

  • Questioning the Officer’s Testimony – If an officer maintains that your behavior on a traffic stop led them to believe you were intoxicated, their observations will be used as evidence of your guilt. For example, the officer may claim you spoke with slurred speech, which can be a sign of inebriation. I’ll review each claim to determine whether the observations are sound.
  • Having Witnesses Speak on Your Behalf – If there were witnesses to your arrest that have a different perspective than the arresting officer, I’ll ask them to speak on your behalf. The police are not infallible, and witness testimony can highlight any mistakes made or show that the officer behaved inappropriately.
  • Questioning the Validity of Chemical Testing – While reliable, chemical testing must be conducted correctly to return accurate results. If there are suspected problems with the breathalyzer device used to test you or the office failed to perform the test according to rules, I’ll make sure the court knows. 
  • Determining Whether There Was Reasonable Suspicion – Unless you were stopped at a DWI checkpoint, the officer must have had reasonable suspicion to stop you. If the stated reasonable suspicion is suspect or extremely broad, it can cast doubt on the rest of the evidence presented against you.
