Criminal Defense of Drunk Driving Charges

No one ever plans on getting arrested for drunk driving after a night out with friends. However, this is a very real consequence if you consume too much alcohol and get behind the wheel of a vehicle.

Here at Angela Arellanes Law, I recognize that even good people make mistakes from time to time. I also believe that all people deserve reliable legal representation, no matter what charges they face. You can rest assured of a strong defense and a thorough review of your case when working with my law firm.

I’m happy to discuss your case during a consultation. Please contact me today to schedule an appointment at my Albuquerque law firm.

How Does Law Enforcement Detect Drunk Drivers?

The police often use one of three methods to determine whether a person is driving while intoxicated:

  • Breathalyzer – Breathalyzers establish whether a driver is over the legal limit of .08% blood alcohol concentration (BAC). These devices require the driver to blow into them, which determine BAC by testing the person’s breath.
  • Blood Testing – Blood testing is considered the most accurate, but it can take a long time for lab results to be completed. As a result, blood testing is less common when drunk driving is suspected.
  • Field Sobriety Testing – During a field sobriety test, the person under suspicion will be asked by law enforcement to perform a series of maneuvers. This can involve walking in a straight line, balancing on one leg for a certain period of time, or following an object with their eyes.

Are These Methods Reliable?

While the above methods have been proven effective time and time again, they’re not completely infallible. Breathalyzers require maintenance and calibration to remain accurate. On the other hand, certain medical conditions and mobility issues can make it difficult to pass a field sobriety test.
