DUI Penalty

Driving under the influence (DUI) is linked to a variety of penalties, some of which have lasting effects. Even if it’s only your 1st offense, you could find yourself serving time in jail and being required to pay an excessive fine. And if you’re convicted of a 2nd or greater offense, penalties will only become more severe.

I’m Angela Arellanes. I’m a criminal defense attorney in Albuquerque who assists DUI clients through  my firm Angela Arellanes Law. In the past, I’ve helped my clients have the charges against them reduced or even dismissed. I achieve favorable results by providing a solid defense, which ensures your best interests are upheld in court.

Penalties and Punishments

Jail time is a possibility for all DUI offenses. Subsequent offenses even carry mandatory terms, ranging from 96 consecutive hours to 10 years. If convicted, you will also be expected to pay a fine, which can be up to $10,000 depending on the circumstances surrounding your arrest and your past criminal history. Those convicted of DUI are also subject to probation, community service, and completion of a substance abuse treatment program.

License Revocation

1st DUI offenses incur a 1-year license revocation, while 2nd and 3rd offenses involve a revocation of 2 and 3 years, respectively. If you’re convicted of a 4th or subsequent DUI offense, your license can be revoked permanently. Your license can also be revoked for one year for refusing a chemical test when requested by law enforcement. Implied consent laws stipulate that all drivers consent to chemical testing when using the roads in the state.

Ignition Interlock Devices

During the period of license revocation, you’ll also be obligated to install an ignition interlock device on your vehicle for a period of one year or longer. These devices take BAC readings, which determine whether you’re able to start your vehicle. If you have alcohol in your system, the vehicle will not start, and you may be subject to additional penalties.
