What Penalties Does DWI Carry in New Mexico?

DWI is taken very seriously by the state. Penalties vary according to the number of offenses and other circumstances, as illustrated here:

  • First Offense – If convicted, you may face up to 90 days in jail, a maximum $500 fine, and one year of probation.
  • Second Offense – Second offenses can incur a maximum jail term of 364 days, with a mandatory 96 consecutive hours behind bars, as well as a mandatory fine of $500 and a maximum fine of $1,000.
  • Third Offense – People convicted of a third offense can face a jail term of no more than 364 days, but with a mandatory term of 30 consecutive days, a mandatory fine of $750 and a maximum fine of $1,000.

Penalties continue to elevate from the fourth offense and beyond. By the eighth offense, convictions include a mandatory 10-year prison term, a maximum $10,000 fine, and five years of probation. Other penalties include license suspension and mandatory attendance of an alcohol abuse class.
