How Does Law Enforcement Determine That a Driver Is Under the Influence?

Law enforcement in Albuquerque typically use one of two methods to determine a driver’s level of inebriation:

• Breathalyzer Testing – Breathalyzers are devices that calculate a person’s blood alcohol concentration (BAC). Motorists will be asked to blow into the device, which will then return a specific BAC percentage. For drivers 21 and older, the legal limit for driving is .08%. For drivers under the age of 21, the legal limit is .02%.

• Field Sobriety Testing – Field sobriety tests look for physical cues that a driver is too inebriated to operate their vehicle. Field sobriety tests include horizontal gaze nystagmus (which evaluates eye movements), the one-leg stand, and the walk-and-turn.
