How Does Law Enforcement Determine That a Driver Is Under the Influence?

Law enforcement in Albuquerque typically use one of two methods to determine a driver’s level of inebriation:

  • Breathalyzer Testing – Breathalyzers are devices that calculate a person’s blood alcohol concentration (BAC). Motorists will be asked to blow into the device, which will then return a specific BAC percentage. For drivers 21 and older, the legal limit for driving is .08%. For drivers under the age of 21, the legal limit is .02%.
  • Field Sobriety Testing – Field sobriety tests look for physical cues that a driver is too inebriated to operate their vehicle. Field sobriety tests include horizontal gaze nystagmus (which evaluates eye movements), the one-leg stand, and the walk-and-turn.

Under New Mexico’s implied consent laws, drivers must submit to a breathalyzer when requested by law enforcement. Failure to do so will result in immediate revocation of your license, regardless of your actual level of inebriation.

What Happens If You’re Arrested for DUI?

The DUI penalties you face will be dependent on the number of previous offenses. However, even first offenses can incur very serious penalties, including jail time and fines. Other punishments include loss of driving privileges, mandatory community service, and attendance of substance abuse classes. You may also be obligated to have an ignition interlock device installed on your vehicle, which will require you to submit to a breathalyzer every time you drive.

Do You Really Need Legal Counsel?

After a DUI arrest, you must secure the assistance of a drunk driving attorney. A skilled and qualified lawyer will ensure that your rights are respected during the process. They can also strive to have charges possibly reduced, which results in decreased penalties.
